The Ministers email, dated October 20th 2006:

Dear Mr. Warner:

Thank you for your email of July 5, 2006 addressed to Honourable Richard Neufeld, Minister of Energy, Mines and Petroleum Resources, and me, regarding the Lee Road Gravel Pit on Salt Spring Island.  As Minister of State for Mining, I am pleased to respond to your email.

Two separate businesses are operated on this property:  non-mining activity (the garbage transfer operation), and a permitted mining operation.  It is incumbent on the permit holder to ensure that as the extraction of gravel is completed on one section of the mine, he applies to have the completed section removed from the Mines Act permit.  The permit holder could then apply for approval or authorization from the Capital Regional District to conduct other business on the area of the property which has been released from the mining permit.  Under the terms of the mining permit, only mining or mining-related operations are permitted on the mine site.

Any of your concerns related to the operation of the garbage transfer operation should be addressed to the Capital Regional District and the Islands Trust.  The Capital Regional District email contact list is available at http://www.crd.bc.ca./emails.htm, and Islands Trust can be contacted at http://www.islandstrust.bc.ca/lup.

Ministry staff have conducted regular inspections of this site on Lee Road and, as the course of their duties permit, they will continue to monitor the site.

The Islands Trust staff consider Hedger's garbage activities "legal, non-conforming"!
